Boxful Events Pty Ltd – Terms and Conditions

These Terms and Conditions of Use (“Terms of Use”) apply to the website located at boxfulevents.au (the “Site”), which is owned and operated by Boxful Events Pty Ltd ABN 82 659 866 369 (“we”, “us” or “our”).

We are authorised to sell alcohol under Packaged Liquor Licence No. LIQP770017973. These Terms also apply to our mobile site, mobile application, and social media platforms (together, the “Sites”).

By using our Sites, you confirm that you accept these Terms of Use and agree to comply with them. If you do not agree, you must not use our Sites.


1. Eligibility to Use Our Sites

  • You must be 18 years or over to use our Sites and purchase alcohol.

  • It is illegal for a person under 18 to falsely represent themselves as being 18 or over.

  • We may decline or cancel any order if we believe it breaches liquor laws or regulations.

  • By using our Sites, you confirm that you are at least 18 years of age and understand the prohibition on supplying liquor to minors.

  • Our Sites are directed to users in Australia. If you access them from outside Australia, you do so at your own risk and must comply with local laws.


2. Purchasing Products

You may only place an order if:

  • you are not a minor;

  • you are not purchasing on behalf of, or intending to supply to, a minor;

  • the delivery address is within our service areas (excluding restricted/dry zones);

  • delivery falls within our licensed delivery hours;

  • you pay the total order price; and

  • you acknowledge that we comply with responsible service of alcohol regulations.

When you click “Place Order”, you make a legally binding offer to purchase. We will confirm acceptance by sending you an order confirmation email. Payment is processed once your order is accepted.


3. Changes to These Terms

We may amend these Terms of Use at any time. Please review them regularly to ensure you understand the terms in effect when using our Sites.


4. Changes to Our Sites

We may update our Sites from time to time to reflect product changes, user needs, legal requirements, or business priorities. We will endeavour to provide reasonable notice of significant changes.


5. Site Availability

  • Our Sites are provided free of charge.

  • We do not guarantee continuous, uninterrupted or error-free access.

  • We may suspend or restrict access for business or operational reasons, with reasonable notice where possible.


6. Account Security

If you create an account, you must keep your login details confidential. We may disable accounts if we reasonably believe security has been compromised or if our Terms are breached.


7. Intellectual Property

All content on our Sites is owned or licensed by us and protected by copyright. You may print or download limited extracts for personal use, but you must not:

  • alter content;

  • use content separately from accompanying text;

  • use content for commercial purposes without our consent.


8. Information Disclaimer

Our Sites are provided “as is”. Content is for general information only and not intended as advice. While we try to keep information up to date, we make no warranties regarding accuracy or completeness.


9. External Links

Links to third-party websites are provided for convenience only. We do not control or endorse those websites and accept no responsibility for their content.


10. User Contributions

If you upload content (e.g. comments, posts), you:

  • grant us a licence to use, reproduce, and distribute it;

  • warrant that you own or control the rights to it;

  • acknowledge that views expressed by users are their own, not ours.

We may remove or restrict content at our discretion.


11. Content Standards

User contributions must not:

  • be defamatory, offensive, unlawful or discriminatory;

  • infringe intellectual property rights;

  • mislead, impersonate, or promote illegal activity;

  • breach any applicable law.

We reserve the right to report breaches to authorities.


12. Limitation of Liability

We are not liable for any damages arising from use of our Sites, except as required by Australian Consumer Law (ACL). Where liability cannot be excluded, it is limited to the extent permitted by law.


13. Viruses and Security

We do not guarantee our Sites are secure or free from viruses. You should use your own antivirus software.


14. Linking to Our Sites

You may link to our homepage fairly and legally, without implying endorsement. We may withdraw linking permission at any time.


15. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and subject to the exclusive jurisdiction of its courts.


16. Trademarks

“Boxful Events” and related names, logos and slogans are our trademarks. You must not use them without our written consent.


17. Prohibited Uses

You must not use our Sites to:

  • break the law;

  • exploit or harm minors;

  • send spam or unauthorised promotions;

  • impersonate others;

  • introduce viruses or malicious code;

  • disrupt or interfere with the Sites’ operation.

We may report breaches to authorities and suspend access immediately.


18. Delivery

  • Delivery instructions are passed to couriers but cannot be guaranteed.

  • Orders returned due to incorrect addresses will incur a $14.95 re-dispatch fee.

  • If the recipient appears under 25, valid ID must be shown. Otherwise, the parcel will be redirected to a collection point.


19. GST

All prices include GST unless stated otherwise.


20. Returns and Refunds

  • Contact us at info@boxfulevents.au within 7 days if you are unsatisfied.

  • Damaged items: do not accept delivery; we will replace them.

  • Lost items (scanned but not delivered): we will send a replacement.

  • Returns must be unused, in original packaging, and in the same condition received.

  • Our policy includes rights under the Australian Consumer Law.

  • Orders cannot be changed or cancelled once placed, unless we agree. Return postage is at the customer’s expense.


21. Assignment

We may transfer our rights and obligations under these Terms in the event of a merger, acquisition or sale.


22. General

  • Prices are in AUD.

  • These Terms and our Privacy Policy form the entire agreement between you and us.

  • If any part is invalid, the remainder remains enforceable.

  • Certain provisions survive termination of these Terms.


23. Definitions

  • Acceptable ID: government-approved proof of age ID (e.g. driver’s licence, passport).

  • Delivery Hours: as permitted under our liquor licence.

  • GST: Goods and Services Tax under the GST Law.

  • Minor: a person under 18 years.

  • Order: a purchase request placed on our Sites.

  • Product: an item advertised on our Sites, including delivery services.

  • Purchase: an Order we have accepted.

  • Service: any service we provide via our Sites.
